These terms and conditions (the Terms and Conditions) govern the use of apps.paulaerospace.ca (the Site), which is owned and operated by The Paul Aerospace Company Ltd.

By using this Site, you agree that you have read and understand these Terms and Conditions and agree to abide by them at all times. Where a separate commercial or academic contract or agreement exists between the user and The Paul Aerospace Company Ltd., the terms and conditions specified in the commercial or academic contract or agreement will take precedence.

Intellectual Property

With the exception of the following:

  1. Plotly licenced under the MIT License (reproduced below in the section titled Plotly);
  2. Fonts licenced under the SIL Open Font License; and
  3. Icons from RemixIcon licenced under the Apache License;

all content published and made available on our Site is the property of The Paul Aerospace Company Ltd. and its creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, javascript code, and anything that contributes to the composition of our Site.

Acceptable Use

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  1. Violate the intellectual property rights of The Paul Aerospace Company Ltd.;
  2. Hack into the account of another user of the Site; or
  3. Act in any way that could be considered fraudulent.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend, or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site and seek compensation from any damages caused by a violation of these Terms and Conditions.

Limitation of Liability

The Paul Aerospace Company Ltd. and our Directors, Officers, Agents, and Employees will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of the Site.

The engineering tools on this Site are provided for use without any warranty. The accuracy of any results generated by these tools is not guaranteed and further engineering assessment, either through a separate arrangement with The Paul Aerospace Company Ltd. or a third party engineer, is recommended before making any decisions with the outputs thereof. By using these tools you are accepting all liability for any damages that may result from the use of the results. The Paul Aerospace Company Ltd. and our Directors, Officers, Agents, and Employees will not accept any liability for any damages that result from the use of results provided by the tools on this Site.

Indemnity

Except where prohibited by law, by using this Site you indemify and hold harmless The Paul Aerospace Company Ltd. and our Directors, Officers, Agents, and Employees from any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of your use of the Site or your violation of these Terms and Conditions.

Retention of User Data

The email address of each registered user is retained in order to authenticate registered users on the Site and to contact registered users when and where required.

Usage statistics for the Site are collected and associated with email addresses of registered users. These usage statistics are limited to recording the registered username and the time each page and tool was accessed. These statistics are retained indefinitely for troubleshooting and legal purposes. Where an unregistered user is accessing publicly available tools, no personally identifiable information is retained other than the IP address of the unregistered user.

All data entered into any tool on this Site is deleted from the server immediately following transmission of the results to the user's browser. All user data transmitted between the user's browser and the server is encrypted using TLS/SSL encyption.

Applicable Law

These Terms and Conditions are governed by the laws of the Province of Ontario.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to use our Site. We will notify registered users by email of changes to these Terms and Conditions or post a notice on our Site.

Plotly

Plotly is used to generate all plots and figures, the use of which is subject to the following MIT License, which applies only to the Plotly javascript code (plotly.js), and no other part of The Paul Aerospace Company Ltd. Web Applications.
